Federal Constitutional Court Rules FCC Decisions Binding on All Courts
The Federal Constitutional Court (FCC) has ruled that under the 27th Constitutional Amendment, its constitutional interpretations are uniformly binding on all courts in Pakistan, including the Supreme Court, and on executive bodies. Authored by Justice Rozi Khan Barrech, the judgment clarified that decisions of the FCC cannot be disregarded and emphasized the principle of res judicata, which prevents reopening matters already conclusively adjudicated.
The ruling came while dismissing a revision petition in a decades-old land dispute, where the Federal Land Commission had attempted to override prior Supreme Court decisions. The FCC declared that order void ab initio, reinforcing the finality of judicial rulings and the rule of law, ensuring consistency and public confidence in Pakistan’s judiciary.
